Terms & Conditions

Introduction

Welcome to Visu Graphic, your premier destination for innovative digital branding and creative design solutions. These terms and conditions govern your use of our website and outline the foundational rules for engaging our professional services. By accessing our platform or commissioning a project, you formally agree to be bound by these legal stipulations. Our agency specializes in high-quality visual branding, motion graphics, user interface design, and creative automation systems. We strongly advise all prospective clients to read this entire document carefully before proceeding with any service requests. Visu Graphic reserves the right to modify or update these guidelines at any time without prior individual notification. Your continued use of our website following any posted changes constitutes your acceptance of the revised terms. If you disagree with any part of these conditions, you must immediately discontinue your use of our digital platforms.

Scope of Creative Services

Visu Graphic provides specialized design solutions tailored to elevate your business identity across various digital and physical mediums. Every project begins with a detailed brief outlining the specific deliverables, timelines, and creative parameters expected by both parties. The exact scope of work is rigidly defined in the final project proposal and cannot be arbitrarily expanded. Any requests for additional features or supplementary design assets outside the original agreement will require a separate evaluation. We pride ourselves on maintaining open communication to ensure the final output accurately reflects your initial creative vision. Our team utilizes industry-standard software and methodologies to craft premium visual assets suitable for modern market demands. We do not guarantee specific business outcomes, increased sales, or enhanced market performance resulting solely from our design work. Our primary commitment is delivering aesthetically pleasing, highly functional, and professionally executed graphic materials according to the agreed brief.

Revisions and Approvals

We incorporate a structured revision process into every project package to ensure your complete satisfaction with the final design. The specific number of revision rounds allocated to your project is clearly defined in your chosen service tier. A revision is defined as a minor adjustment to typography, color balance, alignment, or spacing within the original concept. Completely changing the core design concept after the initial approval phase does not qualify as a standard revision. Such fundamental shifts in project direction will necessitate a newly negotiated scope of work and potential additional billing. Clients are expected to provide consolidated, clear, and actionable feedback within the designated review periods to maintain project momentum. Failure to provide timely feedback may result in necessary timeline extensions or temporary pauses in our creative workflow. Once the final design files are explicitly approved and delivered, any subsequent alterations will be treated as a new standalone project.

Intellectual Property Rights

Visu Graphic respects the creative ownership of digital assets and strictly adheres to established intellectual property laws. Upon full and final payment of all outstanding project invoices, the exclusive copyright of the final approved designs transfers fully to you. You are then completely free to trademark, distribute, and utilize these visual assets across all your commercial channels. However, Visu Graphic retains full ownership of all preliminary concepts, rejected drafts, and underlying source codes developed during the creative process. We reserve the perpetual right to feature the completed project in our professional portfolio and marketing materials. If you require a strict non-disclosure agreement or portfolio exclusion, this must be negotiated before the project commences. Clients must guarantee that any materials, logos, or text provided to us do not infringe upon third-party copyrights. You agree to indemnify Visu Graphic against any legal claims arising from the use of unauthorized materials you supply to our team.

Payment and Billings

Securing our premium design services requires a clear understanding of our financial policies and payment scheduling. We typically require an initial non-refundable deposit before any creative research, wireframing, or conceptual design work begins. The remaining balance is systematically divided into milestone payments corresponding to specific project delivery phases. All invoices are payable within the timeframes explicitly stated on the billing document provided by our accounting team. Visu Graphic retains the right to halt all ongoing design production if scheduled payments are significantly delayed. Final high-resolution assets and source files are only released to the client after the project balance is cleared in full. All pricing is quoted in the agreed currency and may be subject to applicable local taxes depending on your specific jurisdiction. In the event of project cancellation by the client, compensation for all work completed up to that exact date remains strictly payable.

Project Timelines and Delays

We meticulously plan our design schedules to ensure timely delivery of all your essential visual assets and branding materials. Estimated completion dates are provided in good faith based on our current studio capacity and the project's inherent complexity. These timeframes rely heavily on your prompt participation during the feedback, review, and asset-gathering stages of the project. Delays in receiving necessary client approvals or requested content will inevitably push back the final delivery deadline. Visu Graphic cannot be held legally responsible for missed launch dates caused by extended periods of client unresponsiveness. If a project remains dormant for an extended duration due to client inaction, it may be officially archived by our management team. Resuming an archived project will require a formal remobilization discussion and may incur administrative restart fees. We promise to communicate proactively if any unforeseen technical or creative challenges threaten to extend our projected timelines.

Client Responsibilities

A successful creative partnership requires active collaboration and timely provision of necessary resources from the client. You are responsible for delivering clear, comprehensive, and accurate project briefs to guide our initial design concepts. All necessary text copy, brand guidelines, and high-resolution reference images must be supplied before active production begins. You must designate a primary decision-maker to streamline communication and prevent conflicting feedback during the revision rounds. It is your strict duty to meticulously review all drafts for factual accuracy, spelling errors, and brand consistency before final approval. Visu Graphic relies entirely on the accuracy of the information you provide regarding your target audience and market competitors. You agree to maintain a professional, respectful, and constructive tone during all interactions with our dedicated design specialists. Fulfilling these responsibilities ensures a smooth, efficient workflow and guarantees the highest possible quality for your final deliverables.

Limitation of Liability

Visu Graphic strives to deliver flawless design solutions, but we must establish reasonable boundaries regarding legal liability. We provide our website and creative services strictly on an "as is" and "as available" basis without implied warranties. Our agency shall not be held liable for any direct, indirect, or consequential damages resulting from the use of our designs. This includes, but is not limited to, losses of potential revenue, business interruptions, or damage to digital reputation. We cannot guarantee that our web visuals or digital interfaces will function perfectly across all untested legacy browsers. The ultimate responsibility for implementing and testing the final design assets within your specific digital environment rests with you. In any event, our total maximum financial liability to you shall never exceed the total fees paid for the specific project. These limitations apply unconditionally to all claims, whether based on contract, negligence, strict liability, or other legal theories.
